That's actually an excellent test case. I can see that some might argue it is purely a contractual matter between Oracle and a "customer", but since maintaining a level playing field requires that the TCK is indeed offered in a fair, transparent and timely way there should probably be an explicit statement in the governance concerning the Board's authority to at least ask questions and preferably intervene in TCK cases.
