Summary: The assert was firing for NMT_Off and minimal too even though the
size isn't used.
Reviewed-by: gtriantafill, dholmes

Please approve the backport of this bug fix.  The fix has been in the source
code since 9/25 and the patch applied cleanly.  Verified with test added.
