Sean, I do not have a strong reason to argue for pushing these into u40.

Martin,

both fixes have now been integrated into jdk8u-dev.  You'll see backports created off the master bug :

Since we're past the rampdown 2 stage for 8u40 [1], the fixes haven't made 8u40 release. If you feel that these fixes are important for 8u40, I can work with you in getting a phase 2 approval request submitted [2].
