The reasoning for choosing 8u40 as the base for the RI is correct.  Here's my original response to Volker:

    Hi, Volker.

    What you write is correct: Basing the RI on 8u40 mainly reduces
    the risk of not completing the Maintenance Release process in
    time for the April security release.  That’s our primary goal.  Basing
    the RI on 8u252 would require us to validate all of the changes
    between 8u202 and 8u252.

    As I wrote in the proposal, my colleagues and I do intend to
    contribute the MR changes to 8u252, assuming that it’s not too
    much work.  In the worst case, even if 8u252 does not include the
    ALPN and RSASSA-PSS changes, those who work on that release line
    or deploy compatible Java implementations based on code derived
    from OpenJDK would still have 120 days to make it compliant, per
    the License Grant section of the TCK License.

Currently work is underway to contribute the changes to 8u252 in time
for the April 2020 release.
